No. To bring a claim for damages, the buyer has to prove he has suffered a quantifiable financial loss. Assuming he will actually get the shirt, he does not have a financial loss. Similarly, the actual value of the shirt is not affected by this issue either. No financial loss = no damages.

I've spoken to the person in question at length today and tried to make him see sense.

I think I've opened his eyes to the situation and that in due course the right action is taken. As SM said, lets wait to see the outcome in the next couple of days before escalating the situation.

If someone collecting funds, or a leaflet asking for donations, specifically claims that an organisation is a charity when itis not, then they are breaking the law and the police should be notified immediately. If a fundraiser or their materialdoes not specifically claim that the organisation is a charity, but gives the impression that it is collecting for charitywhen it is not, they should be reported to the Office of Fair Trading's Consumer Direct service: www.consumerdirect.gov.uk

In either instance, your constituent should report their concerns to the Charity Commission so that we can work with other organisations to combat scams and protect the good reputation of charities.

No wonder the younger generation is getting worse. A 16/17 year old lad deceives a lot of people by claiming he will donate to charity and when gets more money due to people believing this, he then back tracks and wants to keep the money, for some people to then try cover it up by saying "he's just a kid and kids do stupid things" and then they wonder why these "kids" are then getting caught doing something as bad as this again in the future. People need to stop saying their just kids and kids do stupid things and in fact punish them like any other person as this would stop them from doing it again. He is 16/17 year old and at college so therefore no longer at school and classed as an adult so for me the club need to ban him if he hasn't given the money to charity and lied to a lot of people as that way he will have lost something he liked to do and that's go to watch the rovers. Just my opinion.

It's shocking, it really is. But on what grounds would the club ban him from the Stadium? He hasn't actually done anything wrong to the club, or anything inside the stadium that breaks any rules...

I agree that people need to stop making excuses for someone aged 16 years old saying "he's just a kid". But like I said, how would the club possibly ban him? Unfortunately you can't just ban people from a public place because they committed fraud...

Let's leave it there chaps, the guy won't be pocketing any cash and has clearly realised the error of his ways.  I'm sure it's a lesson learned experience we all make mistakes.
