Hello all. Wonder if you could help me.

Less than 3 months ago my girlfriends car was Part exchanged to a motor trader in Balby as it required too much doing to it so we purchased a car and this car was part of the deal and got approx £100 for it.

The tax was due to end before we purchased the new car and the motor dealer informed us that they would send all the documents off to send their part of the forms off to ensure DVLA are notified it is in their hands and now off the road. It is still clearly for sale on the internet as per this morning.

A letter went to my girlfriend's previous address where she used to live and the occupants at the address have received a letter saying asking us to ring them requiring the status of the car. Then they have received another letter saying we have a £40 fine and it will be doubled if we don't contact them in 10 days. This was due to them not issuing the initial letter and have now said we have a penalty fee to pay.

The fact she does not now live at her previous address DVLA records have not shown that we are at another address and that our new car is clearly registered at our new address is confusing but nevertheless.

Will we still have to cough up the fine if we explain that we are at our new address?

You will do most likely yes.  As far as I know it is the responsibility of you as the seller to inform DVLA that the car has been sold.

We p/e her old car to Evans Halshaw a few years back and whereas they said they'd do the necessary paperwork, they didn't.

I had to write to the DVLA explaining the situation and everything was dealt with swiftly by them. I'd just ring write to them and explain the circumstances.

It is the registered keepers responsibility to inform DVLA if car sold, PE or scrapped. Sorry but you have to pay up.

I sold my car in August and have just received a tax reminder.
I posted the form off the day after selling the car so it either never arrived or the DVLA lost it.
I'll be very annoyed if I get a fine.

Wife had similar. She PX car, Garage said "We sort paperwork", The only paperwork she sent off was for claiming "Road fund" back, which she got 4 weeks later. 6 months later she received notice for using non taxed vehicle. Guess what, she had to pay.

The dealer should have given you a yellow slip from the top right of the v5 to say it was transferred to a motor dealer.   Tell dvla you sent this off the day after you sold the car. Sometimes they waive the fine.
